Africahackon Terms & Conditions & Code of Conduct
1. Our Mission
Africahackon is a collaborative cybersecurity academy dedicated to advancing technical knowledge, promoting ethical technology practices, and fostering innovation across the African technology landscape.
By enrolling, Participants agree to uphold the standards outlined in this Agreement.
2. Legal Status of Agreement
These Terms & Conditions constitute a legally binding agreement between Africahackon (“the Academy”) and the Participant.
This Agreement is governed by the laws of the Republic of Kenya.
Participation and/or payment confirms acceptance.
SECTION A: CODE OF CONDUCT
3. Ethical Conduct
Participants shall:
- Comply with Kenyan, regional, and international laws;
- Refrain from unauthorized system access, malicious hacking, or cybercrime;
- Avoid data theft, manipulation, or unlawful digital activity.
Violation may result in immediate removal and potential legal action under the Computer Misuse and Cybercrimes Act (2018).
4. Respect & Professional Integrity
All Participants must:
- Maintain respectful and professional communication;
- Avoid harassment, discrimination, or misconduct;
- Conduct themselves in a manner consistent with professional cybersecurity standards.
5. Responsible Disclosure
Security vulnerabilities must be reported responsibly to:

Unauthorized exploitation or premature disclosure is prohibited and may result in permanent removal and legal action.
6. Intellectual Property & Confidentiality
6.1 All Academy materials, curriculum, tools, frameworks, and content remain the intellectual property of Africahackon and/or their authors.
6.2 Unauthorized reproduction, recording, distribution, or commercial use is prohibited under the Copyright Act (2001).
6.3 Participants must respect confidentiality obligations regarding shared materials and discussions.
SECTION B: PROGRAMME PARTICIPATION & ACADEMIC REQUIREMENTS
7. Attendance, Engagement & Performance
Active participation is mandatory.
Participants must:
- Maintain minimum 80% attendance;
- Submit required assignments;
- Participate in squad/group activities;
- Meet assessment and exam requirements.
Failure to meet academic standards may result in:
- Academic probation;
- Restricted access;
- Removal from the programme.
Warning notices may be issued prior to removal.
8. Academic Integrity
Plagiarism, cheating, falsification of work, or misuse of programme resources may result in immediate removal without refund.
9. Communication Policy
9.1 Discord is the Academy’s official communication platform.
9.2 All official discussions, requests, submissions, and administrative matters must occur through official Academy channels.
9.3 Communications outside designated platforms shall not be recognized as valid or binding.
SECTION C: FEES, PAYMENT & FINANCIAL OBLIGATIONS
10. Payment Compliance
10.1 Fees are payable in accordance with the selected payment structure (full payment, installment plan, or custom arrangement where approved in writing).
10.2 Payment deadlines are binding once agreed.
10.3 Failure to meet payment deadlines may result in:
- Immediate account deactivation;
- Restriction of access to classes, platforms, and assessments;
- Suspension or removal from the programme.
10.4 Removal for non-payment does not waive the Participant’s financial obligation.
10.5 No Participant shall:
- Sit final examinations;
- Graduate;
- Receive certification;
- Be recognized as alumni;
if any fee balance remains outstanding.
11. Reinstatement Following Deactivation
11.1 Reinstatement after deactivation for non-payment is not automatic.
11.2 Reinstatement may be considered only upon:
- Full settlement of outstanding fees; and
- Academic viability review.
11.3 The Academy reserves the right to decline reinstatement where progression is no longer feasible or cohort capacity has been reached.
11.4 Payment made after deactivation does not guarantee reinstatement, deadline extensions, or reopening of assessments.
12. Deferral Policy
12.1 Deferral is granted at the discretion of the Academy.
12.2 Deferral may require full fee settlement prior to approval.
12.3 Deferred Participants resume from the point of withdrawal and shall not receive a fresh programme start unless otherwise approved in writing.
SECTION D: REFUNDS & CANCELLATION
13. Cancellation by Participant
More than 14 days before programme start:
Up to 50% refund, unless documented exceptional circumstances justify otherwise.
Within 14 days before start:
No refund unless documented emergency is approved.
After programme commencement:
No refunds under any circumstances.
14. Cancellation by Africahackon
If the Academy cancels a programme, a full refund shall be issued.
Approved refunds will be processed within 30 days via the original payment method.
SECTION E: LEGAL PROTECTIONS
15. No Guarantee of Employment
Participation does not guarantee employment, job placement, income, external certification, or professional advancement.
16. Limitation of Liability
To the fullest extent permitted under Kenyan law, Africahackon shall not be liable for:
- Indirect or consequential losses;
- Loss of income, data, or opportunities;
- Outcomes arising from third-party platforms or tools;
- Personal circumstances affecting participation.
Total liability shall not exceed fees paid.
17. Force Majeure
The Academy shall not be liable for delays or failure due to events beyond reasonable control, including system outages, internet disruptions, illness, regulatory changes, or national emergencies.
18. Dispute Resolution
Disputes shall first undergo internal review.
If unresolved, disputes shall be governed by Kenyan law and subject to the jurisdiction of Kenyan courts.
19. Compliance with Kenyan Law
This Agreement aligns with:
- Consumer Protection Act (2012)
- Computer Misuse and Cybercrimes Act (2018)
- Copyright Act (2001)
- Industrial Property Act (2001)
- Constitution of Kenya (2010)
20. Acceptance of Terms
By enrolling and/or making payment, the Participant confirms that they have read, understood, and agreed to these Terms & Conditions.
